Terms of Service

The agreement between you and xigzag, in plain words. No surprises, no buried clauses.

1. The agreement

These Terms of Service ("Terms") are between you ("you", the account holder) and xigzag ("we", "us"). They govern your use of xigzag — the platform you use to create, edit, host and run websites. By creating an account or using the service, you agree to these Terms. If you're agreeing on behalf of a company, you confirm you have the authority to do so.

2. Your account

You must provide accurate information and keep your login secure. You're responsible for activity under your account. You must be old enough to form a binding contract where you live. We offer optional two-factor authentication — we recommend turning it on.

3. What you can build

You may use xigzag to build and run legitimate websites and businesses. You may not use it for anything illegal, deceptive or harmful — see our Acceptable Use Policy, which is part of these Terms. We may suspend or remove content or accounts that breach it.

4. Your content and your sites

You own the content you put into xigzag and the sites you create. You grant us the limited rights we need to host, process, back up and display your sites and to operate the service. Your site is a portable, exportable document — it stays yours. You're responsible for having the rights to the content, images and trademarks you upload.

5. Plans, billing and your customers' payments

You can build for free. Going Live is $19 per site each month (first month free), after which a site that uses more than its included quota grows gently, per unit, with no tier cliffs. You can set a monthly spend cap; we pause over-quota growth at your cap rather than bill past it. Fees are charged in advance and are non-refundable except where required by law.

When your site sells something, your customers pay you directly through your own connected payment provider (such as Stripe). We take 0% of those sales — that money never passes through us. You are the merchant of record for your storefront and are responsible for fulfilment, taxes, refunds and customer service on your sales.

6. Free sites

A free site is genuinely free to build and publish. If you never go Live, we keep it for 30 days and then a further grace period; an unactivated free site may be removed on day 45. Go Live any time to keep a site indefinitely. We'll always show ad-free sites — we never inject advertising into a site we build.

7. Availability and changes

We work hard to keep the service available and your sites online, but we don't guarantee uninterrupted service. We may add, change or remove features. If we make a materially adverse change to a paid feature you rely on, we'll aim to give reasonable notice.

8. Suspension and termination

You can stop using xigzag and close your account at any time. We may suspend or terminate accounts that breach these Terms or the Acceptable Use Policy, that create risk for the platform or others, or as required by law. On termination you can export your sites for a reasonable period before data is deleted.

9. Warranties and liability

The service is provided "as is" and "as available". To the extent permitted by law, we disclaim implied warranties, and our total liability for any claim is limited to the fees you paid us for the service in the 12 months before the claim. We are not liable for indirect or consequential losses, or for losses arising from your sales to your own customers.

10. Governing law and changes to these Terms

These Terms are governed by the laws of the jurisdiction in which xigzag is established, without regard to conflict-of-laws rules. We may update these Terms; if we make material changes we'll update the date above and, where appropriate, notify you. Continued use after a change means you accept the updated Terms.
